The eligibility for may differ from state to state but, the common qualifying points are
- At least one of the spouses is under 14 years of age or under 18 and the marriage is without parental consent or court order
- The couples being under the influence of drugs or alcohol at the time of marriage
- Insanity preventing the ability to give consent
- One partner deceived by the other in order to get consent
- Close relation between the spouses
- Either spouse being divorced from another marriage for less than 30 days
- Abduction of a person with the intention of compelling them to marry
- The couple killed the spouse of one of them in order to marry
- Performing the marriage in less than 72 hours
